Licensing Notice for INK Software Components
INK Content, Inc., a Delaware corporation (“INK”), offers its software product known as SmythOS (“Software”). The Software includes components that are subject to different licensing terms. To promote transparency and ensure proper use, this notice outlines the applicable usage rights, restrictions, and intellectual property provisions governing the Software.
1. License Structure
a. Commercial License Modules
The proprietary features of the Software, including, but not limited to, Build Agents like Sitemap Crawling and Computer Automation; or Agent Hosting, such as Agent Cloud and Enterprise Local runtime, are governed by a commercial license agreement available at https://smythos.com/legal/terms-of-service/. Use of these modules requires a valid license obtained directly from INK. b. Open-Source Modules (MIT License)
Certain build agents, such as Agent Studio, Integrations and Debugger; or Agent Hosting, such as Community Local Edition, are made available under the below MIT License. These features are provided “as is” with permission to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies, subject to the terms of the MIT License.

2. Restrictions on Use
a. Unlicensed Usage Prohibited – Use of any commercial license module without a valid license is strictly prohibited.
b. Reverse Engineering – You may not decompile, reverse-engineer, disassemble, or attempt to derive the source code of any proprietary module.
c. Redistribution – Redistribution of the commercial license module of the software, in whole or in part, is not permitted except when bundled with and distributed as part of an authorized by the applicable License Agreement.
d. Modification of Licensed Code – Modification of commercial-licensed modules is prohibited unless expressly authorized in writing by INK.
3. Intellectual Property Reservations
a. Ownership
i. All rights, title, and interest in and to the Software, including any updates, derivative works, or improvements, remain the exclusive property of INK Content, Inc. or its licensors.
b. Patent Rights
i. While the MIT License allows broad use of the covered software, it does not grant any express or implied patent licenses beyond the right to use the code. INK CONTENT, INC. EXPRESSLY RESERVES ALL PATENT RIGHTS RELATED TO THE COMMERCIAL AND OPEN-SOURCE MODULES TO THE EXTENT NOT COVERED BY APPLICABLE LICENSE TERMS.
c. Trademarks
i. The software and its associated branding, including names, logos, and icons, are protected trademarks of INK Content, Inc. Use of these marks must not:
1. Suggest endorsement or affiliation with INK Content, Inc.
2. Mislead users into believing they are interacting with or receiving support from INK Content, Inc.
3. Be used in a way that implies ownership or authorship of the software by any party other than INK Content, Inc.
Any permitted use of the trademarks must include proper attribution and comply with applicable trademark laws.
4. Trademark Fair Use in Software
a. Fair use of registered trademarks in software is permitted for descriptive purposes (e.g., compatibility statements), provided such use:
i. Is non-misleading;
ii. Does not imply sponsorship or endorsement;
iii. Is not prominently placed in a way that could cause confusion.
Improper or misleading use – such as branding software in a way that makes the end user believe it is developed, authorized, or officially distributed by INK Content, Inc. – is a violation of trademark rights and is strictly prohibited.
